PROBLAY Terms of Service

PROBLAY is an information and analytics software service. PROBLAY provides NFL player-prop and parlay research tools, including probability estimates, projections, correlation and combination analysis, and related informational content, for entertainment and research purposes only.

PROBLAY is not a sportsbook. PROBLAY does not accept or place wagers, does not hold or transmit wagering funds, and is not a party to any bet you may choose to place elsewhere. PROBLAY does not guarantee betting outcomes, winnings, or any financial result, and nothing on PROBLAY should be understood as a promise or assurance of future performance. All analytics, probabilities, projections, prop research, and parlay ideas presented on PROBLAY are informational and research tools only — you are solely responsible for any decisions you make, including any decision to wager, and for the outcome of those decisions.

You are solely responsible for complying with all laws applicable to you, including any laws governing sports wagering in your jurisdiction. You should only participate in wagering activity where it is legal to do so and only through providers licensed to accept it. PROBLAY encourages responsible engagement with sports wagering and does not encourage or condone wagering beyond what you can reasonably afford, or wagering by anyone below the applicable legal age in their jurisdiction.

You must be able to form a binding contract to use PROBLAY, and you are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information when creating your account and to keep it up to date.

PROBLAY offers a free tier and a paid subscription tier (“PROBLAY PRO”), available either as a monthly subscription or as an annual PROBLAY PRO Season Pass, at the subscription price displayed at checkout.

New PROBLAY PRO subscribers on the monthly plan may be offered a 7-day free trial, which requires a valid payment card at signup. The 7-day free trial is intended to allow a new subscriber to evaluate PROBLAY before the first paid subscription charge. Unless you cancel before the trial period ends, your trial will automatically convert to a paid PROBLAY PRO monthly subscription and your payment method will be charged the applicable subscription price. The free trial is offered on a limited, one-time basis and is not available to every account on a repeating basis.

The PROBLAY PRO Season Pass is an annual subscription and does not include a free trial. Your payment method is charged the Season Pass price at the time of purchase, and the Season Pass renews automatically at the same price each year unless canceled before the next renewal date.

Subscriptions renew automatically at the end of each billing period unless canceled before the next renewal date. You can cancel your PROBLAY PRO subscription at any time through your account. When you cancel, your subscription will not renew, but where you have already paid for the current billing period, you will generally continue to have access to PROBLAY PRO features through the end of that already-paid period.

If a subscription payment fails, PROBLAY may allow a short grace period during which PROBLAY PRO access can continue while the payment issue is resolved, after which access will revert to the free tier if the payment issue is not resolved. PROBLAY does not guarantee refunds for any billing period, partial or complete, except where required by applicable law or expressly stated at the time of purchase.

You agree not to:

• Use PROBLAY for any unlawful purpose, including unlawful wagering activity.
• Attempt to gain unauthorized access to PROBLAY, other accounts, or PROBLAY's systems.
• Interfere with or disrupt the operation of PROBLAY or its underlying infrastructure.
• Scrape, resell, or redistribute PROBLAY's analytics or content without permission.
• Misrepresent your identity or affiliation when using PROBLAY.

PROBLAY, including its analytics methodology, design, branding, and content, is owned by FiveX Collective LLC and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use PROBLAY for your personal, non-commercial use, subject to these Terms.

PROBLAY relies on third-party services to operate, including Clerk for authentication, Stripe for subscription billing and payment processing, and Kit for email newsletter delivery. Your use of features involving these providers, such as Google sign-in, is also subject to those providers' own terms.

PROBLAY is provided on an ongoing basis, but we do not guarantee that the service will always be available, uninterrupted, or error-free. We may modify, suspend, or discontinue any part of PROBLAY, or update these Terms, at any time. If we make material changes to these Terms, we will update the effective date above. Continued use of PROBLAY after a change becomes effective constitutes acceptance of the updated Terms.

PROBLAY IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT ANY PROJECTION, PROBABILITY, OR ANALYTIC OUTPUT PRESENTED BY PROBLAY WILL BE ACCURATE OR THAT USE OF PROBLAY WILL RESULT IN ANY PARTICULAR OUTCOME, FINANCIAL OR OTHERWISE.

To the maximum extent permitted by law, PROBLAY and FiveX Collective LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds wagered based on information obtained from PROBLAY, arising out of or related to your use of PROBLAY.

You may stop using PROBLAY and close your account at any time. We may suspend or terminate your access to PROBLAY if you violate these Terms or if we reasonably believe your use of PROBLAY poses a risk to PROBLAY, other users, or any third party.
